Please read these Terms of Service carefully before using Motivatum. By downloading, installing or using the app, you agree to be bound by these Terms. If you do not agree, do not use the app.


1. About Motivatum

Motivatum is a personal life planning application designed to help you set goals, build habits, track daily progress and reflect on your life. Motivatum is independently developed and operated.

These Terms govern your use of the Motivatum mobile and web application and any related services (collectively, the "Service").


2. Eligibility

You must be at least 13 years of age to use Motivatum. By using the Service, you confirm that you meet this requirement. If you are under 18, you confirm that you have the consent of a parent or legal guardian to use the Service.


3. Your account

Guest use

You may use Motivatum without creating an account. In guest mode, all your data is stored locally on your device only. We cannot recover your data if you clear your browser storage or switch devices.

Registered accounts

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at visionaryapps@outlook.com if you become aware of any unauthorised use of your account.

You agree to provide accurate and complete information when creating your account and to keep it up to date.


4. Free and premium plans

Motivatum offers both a free plan and a premium subscription plan. The features available on each plan are described within the app and are subject to change.

We reserve the right to modify, restrict or discontinue any feature at any time, with reasonable notice where practicable.


5. Payments and subscriptions

Premium subscriptions are processed through the Apple App Store or Google Play Store, subject to their respective terms and billing policies. We do not handle payment card information directly.


6. Your content

You retain ownership of all content you create within Motivatum, including your goals, habits, journal entries and reflections ("Your Content").

By using the Service, you grant us a limited, non-exclusive licence to store and transmit Your Content solely as necessary to provide the Service to you. We do not use Your Content for any other purpose.

You are solely responsible for Your Content. You must not enter content that is unlawful, harmful, defamatory, or that infringes the rights of others.


7. Acceptable use

You agree to use Motivatum only for lawful purposes and in accordance with our Acceptable Use Policy, which forms part of these Terms.


8. Intellectual property

The Motivatum app, including its design, code, content, branding and all associated intellectual property, is owned by or licensed to us. Nothing in these Terms transfers any intellectual property rights to you.

You are granted a limited, non-exclusive, non-transferable, revocable licence to use the app on your personal device(s) for personal, non-commercial purposes in accordance with these Terms.


9. Availability and updates

We aim to keep Motivatum available at all times but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates or circumstances beyond our control.

We may release updates to the app from time to time. Continued use of the app after an update constitutes acceptance of any changes introduced by that update.


10. Disclaimers

Motivatum is provided "as is" and "as available" without any warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose or non-infringement.

The app is a productivity and planning tool only. It does not provide medical, psychological, financial, legal or emergency support advice. Please refer to our Disclaimer for full details.


11. Limitation of liability

To the fullest extent permitted by applicable law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, profits or goodwill, arising out of or in connection with your use of or inability to use the Service.

Our total liability to you for any claim arising out of or relating to these Terms or the Service will not exceed the amount you paid to us in the 12 months preceding the claim, or AUD $100.00, whichever is greater.

Nothing in these Terms limits or excludes liability that cannot be excluded under applicable law, including liability under the Australian Consumer Law.


12. Indemnification

You agree to indemnify and hold us harmless from any claims, losses, damages, liabilities or expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party rights.


13. Termination

You may stop using Motivatum at any time. If you have an account, you may delete it via Settings → Your Account → Delete Account.

We reserve the right to suspend or terminate your access to the Service at any time if you breach these Terms or if we reasonably believe your use poses a risk to other users or to the integrity of the Service.

Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination will do so.


14. Governing law and disputes

These Terms are governed by the laws of South Australia, Australia. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of South Australia, unless otherwise required by applicable law in your jurisdiction.

We encourage you to contact us first to resolve any dispute informally before commencing formal proceedings.


15. Changes to these Terms

We may update these Terms from time to time. We will update the "Last updated" date at the top of this page when we do. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. If we make material changes, we will make reasonable efforts to notify you.


16. Force majeure

We will not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemic, war, terrorism, riots, fire, flood, power outages, internet or telecommunications failures, or the acts or omissions of third-party service providers (including cloud infrastructure and hosting providers).


17. Severability

If any provision of these Terms is found to be invalid, illegal or unenforceable by a court of competent jurisdiction, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions of these Terms will continue in full force and effect.
